The developer of the phpMyChat-Plus software has gotten the message about the copyright infringement issue. Here is the screen shot from the Yahoo Group:
In the meantime I’ve activated the backup chat room until a better solution is found.
Despite what the legal sharks may have been planning, Tuxwerx abides by the law on all matters particularly such issues as Copyrights and IP Protection. Tuxwerx doesn’t not and will not condone copyright infringement or piracy of any kind.
If you have issues with Copyrights and patents then use Open Source Alternatives as much as possible to mitigate Copyright and patent liabilities…

Since I’m in such a Comcastic mood I decided to challenge these Vampires:

“I caught your bot snooping around my site and I don’t appreciate your spying attempt. I will block any such attempts to snoop in the future by any means necessary. If you vampires have a problem with my site then come to me directly! I will address any legitimate Copyright or IP concerns IMMEDIATELY. Any material found on Tuxwerx in violation any kind of US Copyright law will be immediately REMOVED!”

Quite by accident, I have discovered that the default package and install of the popular phpMyChat-Plus software, Hosted on SourceForge, may have potential Copyright issues. It appears the developers have used Copyrighted images as Avatars in the software without a proper US License from the Copyright holders.
I have notified the developers of this issue:

Until the Copyright issues on that software are addressed I have pulled it offline and activated the back up Chat room at Tuxwerx.
While I’m no fan of the arcane, archaic US laws concerning Copyrights and Patents, I do not condone piracy. If any material on Tuxwerx is found to have legitimate copyright issues then I remove it and replace it with other material unencumbered by Copyright issues.
Since my day started off so Comcastic, here are 2 more screenshots in the unbroken chain of events and evidence documenting the fraud by the abusive Comcast monopoly:
If I don’t start seeing some results and answers by the State of West Virginia by next week to end the monopoly abuses and fraud by Comcast then I’ll file formal complaints with the Federal Authorities. If State officials are ‘on the take’ for ‘looking the other way’ with regards to this monopoly fraud and abuse in West Virginia they’ll be held accountable for their actions.
If anyone thinks I’ll be silenced or just ‘go away’ is in for a rude surprise. I’m in this fight to the bitter end.
I’m not ruling out suing Comcast but prefer to use that as an option of last resort. I want to give any and all Government agencies and regulators that could have jurisdiction over this matter, a reasonable opportunity to respond to my formal complaints before I entertain the option of a civil action against Comcast.
I personally find the idea of having to pursue a civil action to seek a redress of grievances repugnant when my tax dollars are paying for Government officials and regulators to prevent such monopoly abuses and fraud to begin with!
I wonder if the State of West Virginia is going to pay my attorney’s fee’s to deal with this matter since state official’s are looking the other way on this monopoly fraud and abuse while seemingly pocketing lot’s of BRIBES ‘Campaign Contribution’s’??

I’ve been saying that somebody is being paid a lot of money to cover up and bury the fraud and abuse by the Comcast monopoly. I’ve uncovered a little proof of just that buried in my server logs:
If these Legal sharks are circling you know things are going to get real ugly. You see, firms like the one above are hired by companies and wealthy individuals to cover their backsides when they are in potential trouble legally. These types of PR\Legal firms will use any quaint legal means necessary to bury and hide the malfeasance and potential criminal wrong doing by its clients.
I expect my hosting company will be pressured to kill my Blog and site. I also expect to be dealing with frivolous lawsuits in an effort by Comcast Lawyers, or it’s agents like the one above, to bankrupt me financially hoping to prevent my pursuing any possible legal action against Comcast.
This move is not unexpected. When you’re protecting a billion dollar monopoly you play by Queensbury rules to protect that cash cow and Comcast is doing just that.

I have been informed of potential copyright issues with the Debian package of Real Player 11 I had converted from an .RPM package and stored on the Tuxwerx server.
Until I get some sort of formal legal clearance from RealNetworks I can no longer provide this .deb package.
In the meantime until RealNetworks posts a .deb package you can simply download the .rpm package from Real’s own servers then run that RPM package through alien to convert it to a .deb package and install it like any other .deb package. The .rpm may work on your Debian\Ubuntu system but I had issues with it so I converted it in to a native Debian package for Ubuntu.
No modification of the core code was performed. Only the manner of packaging was altered from an .RPM package to a .DEB package for installation on a Debian based Linux system.
I’ll try to get clearance from RealNetworks but until that happens copyright restrictions prevent me from redistributing that RealPlayer 11 .deb package.
Sorry folks. You can thank the Lawyers for that one…
In what is surely another glorious example of our Broken Government here in West Virginia I received 2 letters dated August 27, 2008 from Julie Boggess at the West Virginia Attorney General’s Office with 2 different answers to the same problem. See for yourself below:
Is it any wonder corporate thugs like the abusive Comcast monopoly can brazenly flaunt the law and rip folks off at will with impunity here in West Virginia??
With State Officials walking away with what is surely a tidy sum in BRIBES ‘Campaign Contributions’ from corporate thugs like Comcast, or it’s lobbyists or agents, I’m willing to bet the State of West Virginia is putting more effort in to trying to further cover up and bury this matter then investigate my original complaint.
This situation would be hilarious if not for the tax dollars funding the corrupt, incompetent Government of West Virginia and the untold millions Comcast is ripping customers off for.
I have in fact heard of the caps Comcast is placing on bandwidth usage starting this fall. All I can say is that when you’re a monopoly paying off the regulators there is no rip off too great or unimaginable. When you’re a monopoly you can impose whatever you want on a captive audience because you don’t have a competitive marketplace to rein in the excesses of the monopoly abuses. Do you really think Comcast would be imposing these kinds of caps if they had to compete fairly with other providers in an open, fair and competitive marketplace?? I doubt it. In fact competitive marketplace pressures would force Comcast and other telecomm providers to build out their networks instead of imposing arbitrary bandwidth caps.
Wait until these Telecomm monopolies start dictating what news stories or content they will or will not carry on their network pipes censoring what is being shown. As these monopolies grow in size and political clout they will easily have the ability to censor anything they find objectionable so the public only sees what the corporate offices wants the public to see.
By allowing abusive Telecomm monopolies like Comcast to have a monopoly in any market we are creating a Digital OPEC where consumer choices are limited and with monopoly prices for substandard services that would otherwise be far cheaper in a competitive marketplace. We complain about OPEC for oil but yet we are blindly creating another OPEC for broadband here at home. Considering so much of our lives and business is done online these days having these OPEC style monopolies on broadband hurts our competitive stance globally.
In Asian markets broadband speed and adoption rates are growing. Not true here in the US where our Telecomm monopolies stifle the marketplace with the greed and monopoly abuses.
If you think dozens of channels of Smiling Bob and his pecker pill scam or the ‘free’ credit report that actually cost’s $15 a month is bad now then brother you ain’t seen nothing yet! Is it any wonder I don’t watch TV anymore and want desparately to CANCEL my cable TV service and just keep just my broadband connection?? Seems like the TV programming today is little more then filler between the commercials and paying through the nose for dozens of channels of Smiling Bob just isn’t worth it anymore…

Ya know, if Comcast actually sold the Blast service as 12 meg instead of 16 meg then the speed claims add up. But when you’re selling what amounts to 12 meg service as 16 meg then there is a huge potential legal liability involved that has to be addressed at some point.
I’m using the fastest servers I can find and overall I’m only getting about 11.3 meg as an overall average on the downside.
To make the lawyers happy I’ll run another batch of more comprehensive speed tests soon. At the moment I’m battling serious, chronic heart disease and quite frankly feel like hell lately. I suspect I may be looking at bypass surgery in the near future so waging this war isn’t doing my failing heart any good.
If I haven’t had heart attack #4 yet I’m certainly close. I’m already eating Nitrostats like TicTac’s and can’t keep that up much longer. The Migraines from the nitroglycerin seem to be a fact of life these days…
